Barc-ee's Safety Waiver & Release of Liability
As the legal guardian or responsible adult for the child and/or dog owner, I acknowledge and agree to the following terms and conditions:
Assumption of Risk
I understand that participation in the activities at Barc-ee's, including the dog park and children's play area, involves inherent risks. These risks include, but are not limited to, physical activity, interaction with other participants (both human and animal), and the use of play equipment.
I voluntarily assume full responsibility for any risks of injury, harm, or loss that might arise from participation in these activities, for both my child(ren) and my dog(s).
Release of Liabilty
I hereby release, waive, discharge, and covenant not to sue Barc-ee's, its owners, employees, agents, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising from or related to any loss, damage, injury, or death that may be sustained by my child(ren) or dog(s), or any property belonging to me, while participating in such activities.
Dog Park Specific Terms
Vaccination Requirement: Dogs must be up-to-date on all vaccinations.
Behavioral Expectations: Dogs must not exhibit aggressive behaviors towards other animals and/or children. Unruly animals, as determined by Barc-ee's staff, will be asked to leave the premises immediately with no refund.
Children's Play Area Specific Terms
Supervision Requirement: Parents or guardians must accompany their minor guests at all times and ensure their safety.
Assumption of Risk for Children: Barc-ee's assumes no responsibility for injuries that occur in the children's play area. The risks associated with carousels, slides, and interactive toy objects are understood and accepted by the parent or guardian.
Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney's fees that the Released Parties may incur due to the participation of my child(ren) or dog(s) in the activities at Barc-ee's, whether caused by negligence of the Released Parties or otherwise.
Medical & Veterinary Consent
In the event of an emergency involving my child or dog, I authorize Barc-ee's to secure from any licensed hospital, physician, and/or medical or veterinary personnel any treatment deemed necessary for immediate care. I agree that I will be responsible for payment of all medical services rendered.
Arbitration Agreement
I agree that any dispute, claim, or controversy arising out of or relating to this waiver or participation in Barc-ee's activities shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. I waive any right to a jury trial or to participate in a class action.
Acknowledgement of Understanding
I have read this waiver and release of liability, fully understand its terms, and understand that I am giving up substantial rights, including my own right to sue and the rights of my child(ren) and dog(s) under my care. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature for this to be a complete and unconditional release of all liability to the greatest extent allowed by law.
